Archer Terms of Service
1. About these Terms
These Terms of Service ("Terms") govern your use of Archer, including our mobile apps, websites, emails, text messages and related services (the "Services"). The Services are provided by Ridley Technologies, Inc., which does business as Archer ("Archer," "we," "us" or "our"). By creating an account or using the Services, you agree to these Terms. If you don't agree, don't use the Services.
Our Privacy Policy explains how we handle your information and is part of these Terms.
2. Eligibility and your account
You must be at least 18 and able to enter a binding contract. You're responsible for the information you give us, for keeping your login secure, and for everything that happens in your account. Tell us right away at hi@archerhome.com if you think someone else has accessed your account.
3. What Archer does
Archer is software that helps you manage your home. It organizes information about your property, finances, equipment and household. It watches for changes and deadlines, explains your options, and, with your approval, takes actions for you, such as drafting and sending messages.
Archer is not a professional adviser. We aren't a real estate broker, mortgage lender or broker, insurance agent or producer, appraiser, home inspector, contractor, lawyer, accountant or tax adviser. Estimates, analyses and recommendations are informational only. They may be wrong or out of date, and they are not professional advice. Before you make an important financial, legal, tax, insurance or property decision, check with a qualified professional.
Sources can be wrong. Archer relies on public records, data providers and the accounts you connect. We don't guarantee that any information is accurate, complete or current, including home values, tax assessments, insurance details and loan figures.
4. Actions Archer takes for you
Only with your approval. Archer sends messages or takes actions outside the app (for example, emailing a contractor, an insurer or your county) only after you approve each one. We don't send or act on your behalf without that approval.
You're responsible for what you approve. When you approve a message or action, it's sent or taken on your behalf, as if you had sent it yourself. You're responsible for reviewing it, for its content, and for the accuracy of the information you provided. Messages we send for you make clear that Archer is sending them on your behalf.
We prepare; you file. For filings such as property tax appeals or exemption applications, Archer may prepare documents and instructions. You decide whether to submit them, and you submit them yourself.
No guaranteed outcomes. We don't guarantee any result, including savings, an appeal outcome, a quote, or a third party's response. Any agreement you make with a contractor, vendor, lender, insurer or other provider is between you and that provider. We aren't responsible for their work, prices, conduct or results.
5. Connected accounts
You can choose to connect outside accounts, such as bank, mortgage, insurance and email accounts, to keep your home record current. Connecting is optional. When you connect an account, you confirm that it's yours or that you're authorized to connect it, and that you have the right to share its data as described in these Terms and our Privacy Policy. Some connections run through third parties such as Plaid, which have their own terms.
Disconnecting stops new data; deleting removes it. Disconnecting an account stops us from collecting new data from it. Information already in your home record stays. To remove it, ask us to delete it, as described in our Privacy Policy.
6. Households and shared homes
You can invite other people, such as a spouse, co-owner or property manager, to a home. Everyone on a home can see everything in that home's record, including data from accounts any member has connected. Before you connect an account or add information, make sure you're comfortable sharing it with everyone on the home. Invite only people you trust, and only people who have agreed to be invited.
7. Partners
You may have been introduced to Archer by a partner, such as your lender, real estate agent, insurer or home inspector. Partners may sponsor your access or have a business relationship with us. When we show you a partner as a possible next step, we label it. Our analysis is the same regardless of who introduced you. Partners receive your information only when you ask us to share it. See our Privacy Policy.
8. Fees and payment
Some features may be offered for a fee. We'll show you the price before you buy. Subscriptions renew automatically until you cancel, and you can cancel any time in your account or app store settings. Purchases made through Apple or Google are billed by them and follow their refund policies. If a partner sponsors your access and the sponsorship ends, we'll tell you before you're charged anything.
9. Text messages
If you opt in to text messages, by texting us first or by giving us your number and agreeing, we'll send you messages about your home and your account. These include reminders, alerts, answers from Archer, and verification codes. How often depends on your activity. Message and data rates may apply. Reply STOP to cancel at any time, and we'll send one confirmation. Reply HELP or email hi@archerhome.com for help. Agreeing to receive texts isn't a condition of any purchase. Carriers aren't liable for delayed or undelivered messages. We may change or end the text program at any time.
10. Your content
You keep ownership of the content you add, such as documents, photos, notes and messages ("Your Content"). You give Archer a license to host, store, process, analyze and display Your Content so we can provide and improve the Services, as described in our Privacy Policy. This license does not let us use Your Content to train AI models. You confirm that you have the rights needed to share Your Content with us and with everyone on your home.
11. Acceptable use
You agree not to:
- use the Services to discriminate against anyone in violation of fair housing or other laws;
- connect an account, or add information about a property or person, that you aren't authorized to share;
- use Archer to send unlawful, harassing, misleading or spam messages;
- scrape, harvest or collect data from the Services without our permission;
- reverse-engineer, decompile or disassemble the Services, or use them to build a competing product;
- interfere with or disrupt the Services or their security.
12. Our intellectual property
The Services, including the software, content, trademarks and logos, belong to Archer or its licensors. We give you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use.
13. Third-party services
The Services rely on, and link to, third parties such as data providers, account-connection services, AI providers, app stores, and the vendors and partners you choose to contact. We don't control them and aren't responsible for their services, content or practices.
14. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, ARCHER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT INFORMATION OR ESTIMATES ARE ACCURATE OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
15. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, ARCHER IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, SAVINGS OR DATA. ARCHER'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
16. Indemnification
You agree to defend, indemnify and hold harmless Archer and its officers, directors, employees and agents from claims, losses and expenses (including reasonable attorneys' fees) arising from your use of the Services, the messages and actions you approve, Your Content, or your violation of these Terms or anyone else's rights.
17. Disputes, arbitration and governing law
These Terms are governed by Colorado law. If a dispute comes up, we'll first try to resolve it informally: contact hi@archerhome.com. Any dispute we can't resolve will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Denver, Colorado, or remotely. Either party may bring an eligible claim in small claims court. You and Archer each waive the right to a jury trial and to take part in a class action.
18. Changes, suspension and termination
We may update the Services and these Terms. We'll notify you of material changes in the app or by email before they take effect, and continuing to use the Services after that means you accept the changes. You can stop using the Services and delete your account at any time. We may suspend or end your access if you violate these Terms or misuse the Services, or if we must do so by law.
19. General
These Terms, together with our Privacy Policy, are the entire agreement between you and Archer about the Services. If any part is unenforceable, the rest still applies. Not enforcing a right doesn't waive it. You may not transfer these Terms without our consent. We may transfer them in connection with a merger, acquisition or sale of assets.
